Terms And Conditions

By purchasing goods from York Coffee Emporium (YCE), you enter a legally binding agreement with us on the following terms. You should read and understand these terms because they affect your rights and liabilities. They do not affect your statutory rights as a consumer. These terms describe the basis for purchase by you and sale by us of the products described on this website.

York Coffee Emporium reserves the right to refuse any order which is deemed to have not been conducted in the correct way, or where any foul play may have taken place. York Coffee Emporium also retains the right to not complete any order it wishes to do so, providing that the monies have not been taken or a full refund is given. By placing an order and giving payment details on our secure server, you, the consumer, are bound and contracted to complete the sale.

Orders

Please ensure when placing your order you have selected the relevant grind you require, and review this selection again at checkout. YCE cannot be held responsible for incorrect grinds being sent out if this information is selected incorrectly by the customer, and no refund or replacement will be offered.

Only wholesale customers with credit accounts set up are eligible to tick the “Add to Account” button. Any customers who tick this button without having a credit account will be contacted for full payment before delivery of said items.

All coffee is freshly roasted to order, and due to the seasonal nature of coffee, some options may not be available at the time of delivery. If this is the case, you will be contacted within 48 hours and a replacement will be offered or your money will be refunded.

YCE cannot accept any returns of roasted coffee, as all coffee is bespoke to each order.

To be eligible to purchase goods on the YCE website and lawfully enter into and form contracts on this website you must:

  • if an individual, be 18 years of age or over; and
  • register your real name, address, phone number, email address and any other details requested.

By offering to purchase goods and services you represent to us that you are 18 years of age or over and authorise us to transmit information, including updated information, to obtain information from third parties, including but not limited to, your debit or credit card numbers or credit reports, to authenticate your identity, to validate your card, to obtain an initial authorisation and to authorise individual purchase transactions.

Payment Method

All prices quoted on this website are in UK pounds and include VAT where applicable, but do not include delivery charges. We take all reasonable care to make our site as secure as we can. Payments are processed through Shopify Payments and PayPal using a secure encrypted server. We accept most major debit and credit cards, along with Shop Pay, Apple Pay and Google Pay. We do not store your full card details at any point.

Delivery

We deliver throughout the UK, and to Europe, the USA and Canada. Full delivery services, prices, weight limits and excluded postcodes are set out on our delivery page. Items will be posted to the address received during the checkout process at the very latest within 28 days.

We aim to dispatch your coffee within 24–48 hours, not accounting for weekends. However, our coffees are roasted fresh to order, so there may be a slight delay for some speciality coffees. If there is a delay, we will notify you of this and agree on another time for delivery. If we cannot agree on another time, we will offer a substitute product or refund.

Delivery is made either by Royal Mail or courier. If the delivery address is different or you have a special request, please ensure you complete the relevant sections. If no delivery address is selected, delivery will be made to the billing address.

Local Pick Up / Collection Points

We offer free collection from a number of collection points in and around York. Current collection points, their collection days and their opening hours are listed on our delivery page.

Where a customer selects local pick up or collection from one of our collection points, it is the customer’s responsibility to collect the order from the selected location during the collection point’s available opening hours.

Orders must be collected within one week of the shipping confirmation email. Any orders not collected within that period will be returned to the York Coffee Emporium roastery, from where they may be collected instead.

Once an order has been delivered to the selected collection point and made available for collection, York Coffee Emporium and the collection point partner cannot be held responsible for orders that are not collected, collected late, or affected by circumstances outside our reasonable control.

Customers should ensure they select the correct collection point at checkout and bring their order confirmation, printed or on a mobile device, when collecting.

Damaged or Incorrect Orders

If for any reason your order is incorrect or damaged, York Coffee Emporium offers a replacement or refund policy. Please contact us to arrange return of the goods.

Refund Policy

If goods are faulty, not as described, or not fit for purpose, you are entitled to a remedy under the Consumer Rights Act 2015. If you tell us within 30 days of receiving the goods, you are entitled to a full refund. After 30 days, we may offer a repair or replacement, and a refund where that is not possible.

Where a consumer exercises their cancellation rights, any refund due will be made within 14 days of the goods being returned to us, or of the consumer providing evidence of having returned them, whichever is the earlier.

Non-Returnable

For reasons of hygiene, refunds or exchanges are not available for used products. This does not apply to faulty goods. Faulty products will be exchanged like for like.

Cancellation Rights

You, the consumer, have the right to cancel your order without giving a reason. The cancellation period ends 14 calendar days after the day on which you receive the goods. To cancel, please contact us, or use the withdrawal form.

Where you cancel, we will refund the price of the goods together with the standard delivery cost of sending them to you. You are responsible for the cost of returning the goods to us. Exchanges and refunds are subject to the goods being in perfect, unused and complete condition in their unopened original packaging.

Roasted coffee is excluded from these cancellation rights, as it is roasted and ground to order and is a perishable good.

Handling Complaints

We will in every case acknowledge complaints within 5 working days. We will in every case advise the consumer how long it will take to resolve the complaint. We will in every case keep the consumer informed throughout the process.

Privacy

At York Coffee Emporium we are committed to protecting your privacy. We use the information we collect about you to process orders and to provide a personalised shopping experience. York Coffee Emporium does not sell, trade or rent your personal information to others.

When you order, we need to know your name, email address, delivery address, telephone number and payment details. This allows us to process and fulfil your orders and to notify you of the status of your order.

When you enter a contest or other promotional feature, we may ask for your name, address and email address so we can administer the contest and notify winners.

We collect your email address for our newsletter to keep you up to date on the latest products from York Coffee Emporium. If you wish to unsubscribe, you can do so using the unsubscribe link in our emails.

All personal data is collected and processed lawfully and in accordance with the UK GDPR and the Data Protection Act 2018. Our full privacy policy sets out how we handle your data, and takes precedence over this summary.

VAT

All loose coffee and tea is zero rated. All other purchases will be subject to the current VAT rate at the time of order.

YCE cannot be held responsible for the content of any of the sites we have linked to and all links are made in good faith.

YCE Websites

The YCE website is provided on an “as is” and “as available” basis without any representation or endorsement made, and we make no warranties, whether express or implied, in relation to it and its use. You acknowledge that we cannot guarantee and cannot be responsible for the security or privacy of the website and any information provided by you. You must bear the risk associated with the use of the Internet.

Whilst we will try to ensure that material included on the website is correct, reputable and of high quality, we cannot accept responsibility if this is not the case. We will not be responsible for any errors or omissions, or for the results obtained from the use of such information, or for any technical problems you may experience with the website. If we are informed of any inaccuracies in the material on the website, we will attempt to correct this as soon as we reasonably can.

In particular, we disclaim all liabilities in connection with the following:

  • incompatibility of the website with any of your equipment, software or telecommunications links;
  • technical problems including errors or interruptions of the website;
  • unsuitability, unreliability or inaccuracy of the website; and
  • failure of the website to meet your requirements.

Limit of Liability

We will not be liable to you or any third party for any consequential or incidental damages for pure economic loss, loss of business, loss of profits or contracts, loss of anticipated savings, wasted expenditure, loss of data, waste of management or office time, damage to machinery or equipment, or for any indirect or consequential loss or damage of any kind, however arising and whether caused by negligence, breach of contract or otherwise.

Our liability in connection with any product purchased through our site is strictly limited to the purchase price of that product. This does not include or limit in any way our liability for:

  • any matter for which it would be illegal for us to exclude our liability;
  • under section 2(3) of the Consumer Protection Act 1987;
  • death or personal injury caused by our negligence;
  • fraud or fraudulent misrepresentation.

Entire Agreement

These Terms form the entire basis of any agreement reached between you and us.

Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of England, and any disputes will be decided only by the English courts.
